Terms of service

  1. Do’s/Don’ts
  1. General Limits - NU_M00N reserves the right to refuse works not limited to : Racist caricatures, Cultural Appropriation ( Beadwork/Patterns/War Bonnets/Etc for non-indigenous customers ), Explicit racism/Homophobia/Sexism ( symbolism/violence/slurs/uniforms/etc ).

Requesting work of any of this content will immediately disqualify you from the commission pool and you will be placed on a blacklist. NU_M00N does not create fursuits  of copyrighted characters.

  1. Technical Limitations -  NU_M00N does not currently take commissions for overly realistic (lifelike), complex  robotics/markings, or characters with many gradients ( unless explicitly opened for experimental commissions ). Questions on what falls under the above can be clarified via communication with NU_M00N. NU_M00N will refuse any request to replicate or imitate a fellow artist’s work.

As a newer maker, some aspects of the work are still in the intermediate level and should be expected to have flaws that are consistent with a maker who is still working to master the craft. To assure customer satisfaction free repairs for items like popped seams within the first month of wear can be discussed and performed on a case-by-case basis. NU_M00N can also provide resources on how to perform repairs yourself, where to find materials used to do so, etc.

  1. Things We Are Happy to Do -  NU_M00N is open to creating works of closed species, fursuits with the intention of being used in NSFW dynamics, etc. Once a fursuit leaves NU_M00N’s studio it is fully free for the owner’s personal use. ANY Commercial use must be noted prior to entering a contract with NU_M00N and requires a separate commercial use agreement.
  2. Who We Work With/Boundaries   -  NU_M00N reserves the right to refuse business with anyone at any time. If a customer or potential customer is found to partake in proven abusive, or illegal activity that harms others, the slot will be voided and the customer will be blacklisted.

  2. Refunds/Limitations and Liability - If there’s a sudden change in your financial status and you require a refund, you must send notice to NU_M00N of the request immediately providing the reason. We request that you DO NOT  open a paypal dispute before attempting to open a direct line of communication with NU_M00N regarding this, as required by PayPal’s terms of service ( you will be blacklisted ).

When your work has passed a certain stage of production, ( materials bought/near finished ) a full refund cannot be issued ( within reason, we are always able to discuss partial refunds on a case-by-case basis ). If no progress has been made (without active communication) for over 3 months from payment completion, NU_M00N is required to refund the purchase in full. Progress includes; materials purchase, concept art, base creation, base alterations, etc. NU_M00N is not responsible for supply chain delays, shipping issues, or damage caused after the product leaves the studio.  All fursuit parts being shipped are required to have shipping insurance.

  1. Payment Plans - Payment plans are accepted, but will incur an additional 5% convenience fee on top of any discussed sale cost. Payment plans may not be longer than 6 months. A late fee of $100 will be incurred for any late payment of over 2 weeks. No work will begin on the project until the balance due is paid in full. Exceptions may be made in writing at NU_M00N’s discretion.  Balances that are late for more than 30 days will put this contract in Default.
  2. Default/Termination of Contract -  If either party fails to perform or breaches any material provision of this Agreement (“Defaulting Party”), the other party (“Non-Defaulting Party”) shall have the right to terminate this Agreement, provided that the Non-Defaulting Party has first provided written notice to the Defaulting Party detailing the breach and has allowed 3 days to cure the breach, unless the breach is due to missed payment.

The Defaulting Party shall forfeit any payments sent or received, and the Non-Defaulting Party shall be under no obligation to make further payments or return any received payments. Any work-in-progress or partially completed deliverables shall be returned or retained by the Non-Defaulting Party, at their sole discretion. The Defaulting Party shall immediately return any materials, assets, or information provided by the Non-Defaulting Party under this Agreement.

Termination under this section shall not limit the Non-Defaulting Party’s right to pursue any other remedies available under law or equity, including the right to seek damages or specific performance. Within 14 days of termination, the parties shall settle all outstanding amounts owed and return any property belonging to the other party. The provisions related to confidentiality, intellectual property, and dispute resolution shall survive termination.

  1. No Deadlines -  NU_M00N DOES NOT WORK WITH DEADLINES . This has proven to reduce quality of work and increase likelihood of both customer and artist disatisfaction . Please note this means that you will not be provided with a time frame in which the product will be completed. Consistent updates are always provided via Trello or DM.
  2. Alterations/Edits -  Edits and Alterations must coincide with current progress of the fursuit (ex; a change to the face shape must be made during the foam base carving phase). Upon receiving progress photos, the client is responsible for providing clear and concise feedback on any changes they’d like made at that stage. Any drastic or heavy alterations (change of ear style after ears are installed and approved) will incur a $100 fee.
  3. Shipping + Handling -  NU_M00N is not responsible for freight handlers’ handling of packages. The cost of standard domestic shipping and shipping insurance will be included in the price of the commission. Any requirements outside of standard shipping (next day air/customs/etc) are to be incurred at the client’s expense.
  4. Communication - NU_M00N is  open to any communication however we cannot guarantee immediate replies. Expect a reply within 1-2 business days. You are permitted to resell the piece for what it was purchased for if you have not added value. Revisions and modifications are at the customer’s discretion once it is in their possession.

You are expected to credit NU_M00N as the artist, DO NOT CREDIT YOURSELF for our work. If you are planning on using NU_M00N’s work commercially you are expected to explicitly state that before work is started/payment is accepted so we can discuss fees (print licensing/commission per sale) and NU_M00N can provide you with the Commercial Use Agreement .
